KABUL: The Independent Commission for Overseeing the Implementation of Constitution (ICOIC) on Sunday said that different government institutes violated the constitution on regular basis.
Latifur Rahman Sayed, a member of the ICOIC, in a joint press conference said the constitution has been violated frequently in by different government organizations the past 13 years but no one was brought to the court of justice.
He said that according to the constitution, the national unity government has no legal ground to stand on. The unity government emerged after a deal. The government should amend the constitution and honor its promises made regarding implementation of the laws. Different laws were approved by the parliament but were not enforced, he added.
Pointing to the violation of laws, he said the law for prisons and jails protects rights of prisoners but the Afghan inmates are living in a difficult situation as the law could not be enforced the way needed.
“We visited around 21 prisons in the country but the inmates are not enjoying the rights guaranteed by the law on prisons. We visited Pul-e-Charkhi Prison. The prison was constructed for 500 inmates, but currently there are more than 10,000 prisoners behind bars,” he said.
He further said that the ICOIC has limited authority and playing advisory role to the government. Urging the government for amendments, he said that several articles need explanations but without amendment it was not possible.
Some political affairs analysts believe that the constitution has been used by influential figures for their own objectives rather than running affairs of the state smoothly and bringing balance in power of the government institutes.
Habibullah Sangar, an analyst, said the government should support and implement the laws without any discrimination.
“What we have observed in the past 13 years is that the constitution has been violated all the time by the high-ranking officials and state-run organizations,” he said.
He asked the government to make sure the constitution has not been violated by anyone because violations of laws by authorities is giving reason to public to commit crimes and support anti-state elements.
