Afghanistan’s legal system completely dismantled, warns EU

KABUL – The European Union has voiced its concerns over the human rights situation in Afghanistan during the 78th Session of the United Nations General Assembly Third Committee. In an interactive dialogue with the Special Rapporteur on the situation of human rights in Afghanistan, the EU expressed its unwavering support for the Special Rapporteur’s mandate.

The European Union highlighted the dire conditions in Afghanistan, where the legal system has been completely dismantled. The country is now governed by edicts, with judges, prosecutors, and lawyers removed from the legal system. The EU also pointed out that women have been marginalized in all aspects of Afghan society.

The EU strongly condemned the systematic oppression of women and girls by the Taliban, emphasizing the need for the full enjoyment of their human rights, empowerment, participation, and protection from violence. The EU raised concerns about potential gender-based persecution in Afghanistan, which could constitute a crime against humanity according to the Rome Statute.

Afghanistan’s ban on women working for the UN and NGOs was also a point of concern, as it severely impacts the delivery of life-saving assistance and essential services, particularly for women-led households. The EU called for the Taliban to cease their human rights violations and abuses and to restore civic space, allowing NGOs, civil society, journalists, and media workers to operate freely.

The EU highlighted issues such as extra-judicial killings, arbitrary detentions, physical abuse, torture, enforced disappearances, and ill-treatment of suspects, as well as targeted attacks against ethnic and religious minorities and discrimination against LGBTI persons. The EU emphasized the importance of justice and accountability for these human rights violations, with a focus on the victims and survivors.

Finally, the European Union stressed the need for an inclusive political process in Afghanistan, involving individuals from various ethnic and religious groups and minorities, to ensure long-term peace, stability, and prosperity in the country.
